ODA Proposes HME Rule Changes for PASSPORT – Comments Due April 16

The Ohio Department of Aging is proposing to amend OAC 173-39-02.7. This rule regulates HME providers for individuals enrolled in the PASSPORT Program. According to the ODA announcement, “ODA’s proposed amendments would add clarity to the rule and update its terminology, but not add any requirements for ODA-certified providers of home medical equipment and supplies”.

Click here for details including the proposed rule and the agency’s “Business Impact Analysis” as required by Ohio’s Common Sense Initiative Office (CSIO) for any state regulation. The proposed rule changes are posted in a format for easy review on pages 2-3.  The remaining pages (4-9) are the BIA.

We encourage members to review the proposed new rule and offer ODA any recommendations for improving it if you’re a PASSPORT provider. ODA will share the comments it receives with CSIO.  OAMES will also submit comments focused generally on making delivery requirements consistent with other payers but hearing from individual providers is extremely beneficial especially in context of the business impact. Please note CSIO’s mission is to reduce unnecessary adverse impacts on Ohio businesses created by state rules so this is an excellent opportunity to weigh in with any concerns.

Please submit all comments no later than Sunday, April 16, 2017 at 11:59PM. To make a comment, please (1) email rules@age.ohio.gov and place the rule number in the subject line or (2) use the “submit comment” button in ODA’s online rules library.  If you do submit comments, please share a copy with Kam Yuricich at the OAMES office so we can track members’ input.
